Italy’s Constitutional Court has vindicated martyred Distomo, rekindling hopes for the final justice of the relatives of the victims of Nazi brutality.
On April 10, Good Friday, Italy’s highest court issued a decision of particular historical and legal significance, opening the way for claims for compensation by Distomo for the German atrocities it suffered during the occupation. On June 10, 1944, in an unspeakable war crime, units of the armored German army surrounded the village and massacred more than 200 residents.

This decision, notes Leonidas Chrysanthopoulos, ambassador emeritus, “rejects the appeal of the German Railways in Italy, from whom Distomo was seeking compensation, stating that ‘foreign citizens, victims of war crimes and crimes against humanity committed abroad, can seek compensation through Italian justice,’ effectively overturning a previous 2023 law that prohibited foreign victims from filing such lawsuits in Italian courts.”
In simple terms, this ruling vindicates those who argue that Greece—since its governments and judiciary do not rise to the occasion—can seek justice through… third parties. The legal journey of Distomo in Italy, as described by Christina Stamouli, a distinguished lawyer and custodian of the family archive, has been a difficult 25-year path filled with legal victories and political defeats.
Especially since 2002, when the late Giannis Stamoulis, the inspirer and leading figure behind the legal claims for compensation for the victims of the massacre, reached the bitter conclusion that the historic ruling of Livadeia—which had vindicated the victims—could not be enforced in Greece.
He reached this conclusion when the Supreme Special Court ruled (May 2002), in another case, that Greek courts lack jurisdiction over cases against foreign states. This approach, combined with public reactions to attempts to seize German assets in Greece, signaled to a legal mind like Stamoulis—who read judicial developments politically as well—that the Greek government was once again reluctant to confront Germany.

The rights of the tortured victims
Almost inevitably, he sought the solution offered by European law, namely to pursue enforcement in another European state. He began with Belgium and Italy, where the process soon yielded positive results. Italian judges, with few exceptions, strongly uphold the right of the tortured victims of the massacre to demand from Germany a genuine apology in action—not empty gestures or symbolic gifts.
After a tug-of-war that even reached the International Court of Justice in The Hague, we have now arrived at today’s ruling, which brings closer the possibility of completing enforcement procedures that began there 25 years ago. It is quite possible that the case will once again pass through the gates of the iconic building in The Hague.
But what is the stance of Greek governments and officials on this matter? “Only words, unfortunately,” observes Ms. Stamouli.
“Especially the last two governments have put this major national issue in the deepest drawer of the Foreign Ministry. A few diplomatic notes for appearances, and nothing more—while Germany closely and continuously monitors developments at the highest institutional level and adjusts its policy.”
She reminds us that since the filing of the Distomo lawsuit (1995), Germany’s official position has gradually shifted—from “the reprisals were lawful acts of war,” to “it is too early to discuss,” or “you have waived your claims,” then “why bring this up after so many years?” and recently “let’s focus on historical memory—it is more important for both sides.” Germany has a national strategy to never pay its debt to our country. Greece?
The reasoning of the Italian Supreme Court on the Greeks’ claim
Stefanos Fourtounidis, who voluntarily handles claims by victims of the German occupation, notes in contrast that this decision—filed by the German Railways company against the Region of Central Greece, which acts as the legal representative of the victims—concerns exclusively Italian citizens.
He states:
“After Germany’s second appeal against Italy, filed at the International Court of Justice in 2022, Italy issued a legislative decree, later ratified by parliament, which:
a) prohibited enforcement measures against the German state in Italy, and
b) provided that victims of German atrocities in Italy who have obtained final court rulings will be compensated from a special fund.
The Italian Supreme Court ruled in its recent decision that this law applies exclusively to Italian citizens, and that the seizure imposed by the victims of the Distomo massacre—based on the final ruling of the Livadeia Court—remains unaffected. This decision demonstrates the Italian judiciary’s commitment to justice as a defining element of a civilized society.”
