The legal framework in our country only recognizes marriage between persons of different sexes, protected by the Constitution. Gender difference is a self-evident and fundamental condition and protects the interest of children with the model of father and mother. Establishing same-sex marriage is not required by European law; it is unconstitutional and degrades the concept of marriage instead of strengthening it. Let’s not play with the institutions.

Marriage as a union of two persons of different sexes
“In our law, difference of sex is a fundamental condition of marriage, and its absence renders marriage void and unconstitutional.”

Matrimonial laws are the first to be endangered when they are well established if they are established for the sake of righteousness in every city (Plato’s Laws, 721a). According to Plato, marriage laws are so important that if enacted correctly, they entail the good and prosperity of the whole city. Current affairs are heavily concerned with the issue of the introduction of marriage between persons of the same sex in our country. Many questions require an answer: What is the first thing that applies today? Is there a need for new legislation and is this required by European law? Is it imposed by the principle of equality? What will be the consequences, especially for children? How will children be protected? Since the matter is very serious, allow me a few thoughts.
Regarding the applicable law: Marriage, civil or religious, is contracted in our law between persons of different sexes, otherwise it is non-existent and has no legal consequences. According to the Supreme Court (Αρειος Πάγος), for the element of gender difference, the unsurpassed definition of Modestinus will be taken into account (“marriage is the union of man and woman for the completion of all life, divine and human right society” = marriage is the union of man and of the woman with the aim of the common course and the sharing of all life, and at the same time the society of divine and human law), where the gender difference is mentioned as an element of the status of marriage. This does not contradict the principle of equality and the free development of the personality guaranteed by the Constitution, because the principle of equality, which excludes gratuitous arrangements or the unjustified assimilation of dissimilar situations, requires the uniform treatment of persons, who are under the same and not different conditions. In other words, the non-recognition of same-sex marriage is justified because they are under different circumstances.
Regarding the principle of equality and equity in marriage, our Family Law contains many applications. For example, the same positive conditions are absolutely required for the conclusion of marriage, e.g., both males and females must be at least eighteen years of age. Spouses decide together on every matter of married life and are obligated to contribute jointly, according to each one’s strengths, to meet family needs. Moreover, it is the duty and right of the parents-spouses to take care of the minor child. This is exercised jointly, even after the dissolution of the marriage, unless it is justified and in the interest of the child to be exercised by one spouse.
Article 12 of the European Convention on Human Rights (ECHR), according to which men and women have the right to marry, distinguishes the gender differences in marriage.
According to Article 21 § 1 of the Constitution, the family, as the foundation of the maintenance and promotion of the Nation, as well as marriage, motherhood and childhood are under the protection of the State. The constitutional concept of marriage is limited to its essential elements that apply over time in Greek society and to the fundamental principles that govern it in our own legal order, so it is a permanent cohabitation between two persons of different sexes, entered into freely and according to a certain procedure and governed by the equality of spouses. The common legislature cannot alter these fundamental characteristics of marriage. It does not infer a prohibition to regulate free unions, but these will not be protected by Article 21 § 1. Nor can a different marriage than the one protected by the Constitution in Article 21 § 1 be legislated, because that would be unconstitutional.
Therefore, in our law, gender difference is a fundamental condition of marriage, and its absence renders marriage non-existent and unconstitutional. Spouses’ relations are governed by equality and co-decision.
Regarding the need for legislation and the consequences:
1. It is not required by the ECHR and the European Court of Human Rights (ECtHR) to introduce marriage between persons of the same sex. There is an obligation to establish an alternative form that does not necessarily entail unalterable consequences with marriage, e.g. to allow adoption. Something like this exists in our country and the cohabitation agreement is permitted regardless of gender difference. The covenant has the same effects as marriage and guarantees the children’s rights. A child born in consanguinity (of persons of different sexes) is like a child born in marriage. It does not allow joint adoption to protect the children because the agreement can also be terminated unilaterally, and this is in line with the ECHR. The establishment of the cohabitation agreement between persons of the same sex makes the establishment of marriage unnecessary. Regardless of the objections to adopting the pact, the problems of children’s origin, alimony, inheritance law, insurance and pensions are resolved.
2. It is not about marriage equality. For example, different ways of creating kinship are envisaged according to gender. Is this also against equality? Equality means that the child’s interest comes first, that the parents participate proportionately to the needs of the family and exercise custody together. Of course, there are many problems between spouses and parents, but they are not solved by establishing marriage between persons of the same sex, nor is it assumed that they will be suitable parents.
3. The child needs two role models, the father and the mother. The child in a same-sex marriage with father 1 and father 2 will never call a woman “mother” or, conversely, a man “father”.
4. It is asked how the child will be protected, if two people of the same sex raise it and one of them suffers something. Our law has child protection mechanisms, such as guardianship and guardianship of minors. The child does not end up in the institution so easily.
5. The artificial kinship of adoption is intended to ensure a family for the child and not to resolve childlessness in any way. It is allowed in our law both married and unmarried. However, married people are usually advantageous as prospective adoptive parents, because the child’s interest is best served when he grows up in a family modeled after the father and mother. In addition, only married couples are allowed the so-called joint adoption, i.e. for both spouses to adopt the same child. If “marriage” between persons of the same sex is established, inevitably, adoption will also be allowed, otherwise it will be considered discrimination. But is this what is really in the interest of the child, who, as we emphasized, is deprived of the opportunity to have a paternal and maternal role model? Besides, the social services will face insurmountable difficulties with the registry of prospective adoptive parents. If they propose not to register a same-sex couple or, conversely, to register an opposite-sex married couple because it is in the best interests of the minor, they will be accused of discriminating against a “married” same-sex couple. Again the victim will be the minor child.
Conclusion: The legal framework in our country only recognizes marriage between persons of different sexes, which is protected by the Constitution. Gender difference is a self-evident and fundamental condition and protects the interest of children with the model of father and mother. Establishing same-sex marriage is not required by European law, it is unconstitutional and degrades the concept of marriage instead of strengthening it. Let’s not play with the institutions.

Ο γάμος ως ένωση δύο προσώπων διαφορετικού φύλου
«Στο δίκαιό μας, η διαφορά φύλου είναι θεμελιώδης προϋπόθεση τέλεσης γάμου και η έλλειψή της καθιστά τον γάμο ανυπόστατο και αντισυνταγματικό.»

Γαμικοί δή νόμοι πρῶτοι κινδυνεύουσιν τιθέμενοι καλῶς ἂν τίθεσθαι πρός ὀρθότητα πάσῃ πόλει (Πλάτωνος Νόμοι, 721α). Κατά τον Πλάτωνα, είναι τόσο σημαντικοί οι νόμοι για το γάμο, ώστε αν θεσπίζονται σωστά, συνεπάγονται το καλό και την ευημερία όλης της πόλης. Η επικαιρότητα απασχολείται έντονα με το ζήτημα της εισαγωγής του γάμου μεταξύ προσώπων του ιδίου φύλου στη χώρα μας. Πολλά ερωτήματα ζητούν απάντηση: Τι ισχύει καταρχάς σήμερα; Υπάρχει ανάγκη νέας νομοθεσίας και μήπως αυτό επιβάλλεται από το ευρωπαϊκό δίκαιο; Μήπως επιβάλλεται από την αρχή της ισότητας; Ποιες θα είναι οι συνέπειες και ιδίως ως προς τα παιδιά; Πώς θα προστατευθούν τα παιδιά; Επειδή το θέμα είναι πολύ σοβαρό, ας μου επιτραπούν μερικές σκέψεις.
Ως προς το ισχύον δίκαιο: Ο γάμος, πολιτικός ή θρησκευτικός, συνάπτεται στο δίκαιό μας μεταξύ προσώπων διαφορετικού φύλου, αλλιώς είναι ανυπόστατος και δεν έχει έννομες συνέπειες. Κατά τον Άρειο Πάγο, για το στοιχείο της διαφοράς φύλου, θα ληφθεί υπόψη ο αξεπέραστος ορισμός του Μοδεστίνου («γάμος εστί ανδρός και γυναικός συνάφεια προς συγκλήρωσιν του βίου παντός, θείου τε και ανθρωπίνου δικαίου κοινωνία» = ο γάμος είναι η συνάφεια του άνδρα και της γυναίκας με σκοπό την κοινή πορεία και το μοίρασμα όλου του βίου, συγχρόνως δε η κοινωνία του θείου και ανθρώπινου δικαίου), όπου η διαφορά φύλου αναφέρεται ως στοιχείο της υπόστασης του γάμου. Αυτό δεν αντίκειται στην αρχή της ισότητας και της ελεύθερης ανάπτυξης της προσωπικότητας που κατοχυρώνονται από το Σύνταγμα, διότι η αρχή της ισότητας, η οποία αποκλείει χαριστικές ρυθμίσεις ή την αδικαιολόγητη εξομοίωση ανόμοιων καταστάσεων, επιβάλλει την ομοιόμορφη μεταχείριση των προσώπων, τα οποία βρίσκονται κάτω από τις ίδιες και όχι διαφορετικές συνθήκες. Με άλλα λόγια, η μη αναγνώριση του γάμου μεταξύ προσώπων του ιδίου φύλου είναι δικαιολογημένη, διότι βρίσκονται κάτω από διαφορετικές συνθήκες.
Ως προς την αρχή της ισότητας και της ισονομίας στο γάμο, πολλές εφαρμογές περιέχει το Οικογενειακό μας Δίκαιο. Για παράδειγμα, για τη σύναψη του γάμου απαιτούνται απολύτως οι ίδιες θετικές προϋποθέσεις, λ.χ. και ο άνδρας και η γυναίκα πρέπει να έχουν κλείσει τα δεκαοκτώ τους χρόνια. Οι σύζυγοι αποφασίζουν μαζί για κάθε θέμα του συζυγικού βίου και έχουν την υποχρέωση να συνεισφέρουν από κοινού, ανάλογα με τις δυνάμεις του καθενός για την αντιμετώπιση των οικογενειακών αναγκών. Καθήκον και δικαίωμα εξάλλου των γονέων – συζύγων είναι η γονική μέριμνα για το ανήλικο τέκνο και αυτή ασκείται από κοινού, ακόμη και μετά τη λύση του γάμου, εκτός αν είναι δικαιολογημένο και συμφέρον για το παιδί να ασκείται από τον ένα σύζυγο.
Αλλά και το άρθρο 12 της Ευρωπαϊκής Σύμβασης για τον Δικαιώματα του Ανθρώπου (ΕΣΔΑ), σύμφωνα με το οποίο ο άνδρας και η γυναίκα έχουν το δικαίωμα να συνάπτουν γάμο, διακρίνει τη διαφορά φύλου στη σύναψη γάμου.
Kατά το άρθρο 21 § 1 του Συντάγματος, Η οικογένεια, ως θεμέλιο της συντήρησης και προαγωγής του Έθνους, καθώς και ο γάμος, η μητρότητα και η παιδική ηλικία τελούν υπό την προστασία του Κράτους. Η συνταγματική έννοια του γάμου περιορίζεται στα ουσιώδη στοιχεία του που ισχύουν διαχρονικά στην ελληνική κοινωνία και στις θεμελιώδεις αρχές που τον διέπουν στη δική μας έννομη τάξη, άρα πρόκειται για μια μόνιμη συμβίωση δύο προσώπων διαφορετικού φύλου, που συνάπτεται ελεύθερα και κατά ορισμένη διαδικασία και διέπεται από την ισονομία των συζύγων. Ο κοινός νομοθέτης δεν μπορεί να μεταβάλει αυτά τα θεμελιώδη χαρακτηριστικά του γάμου. Δεν συνάγεται μεν απαγόρευση ρύθμισης ελεύθερων ενώσεων, αλλά αυτές δεν θα προστατεύονται από το άρθρο 21 § 1. Ούτε μπορεί να θεσπισθεί νομοθετικά άλλος γάμος από αυτόν που προστατεύει το Σύνταγμα στο άρθρο 21 § 1, διότι αυτό θα ήταν αντισυνταγματικό.
Επομένως στο δίκαιό μας, η διαφορά φύλου είναι θεμελιώδης προϋπόθεση τέλεσης γάμου και η έλλειψή της καθιστά τον γάμο ανυπόστατο και αντισυνταγματικό. Οι σχέσεις των συζύγων διέπονται από την ισονομία και τη συναπόφαση.
Ως προς την ανάγκη νομοθέτησης και τις συνέπειες:
1.Δεν επιβάλλεται από την ΕΣΔΑ και το Ευρωπαϊκό Δικαστήριο Δικαιωμάτων του Ανθρώπου (ΕΔΔΑ) να εισαχθεί γάμος μεταξύ προσώπων του ιδίου φύλου. Υπάρχει υποχρέωση για θέσπιση εναλλακτικού μορφώματος που δεν είναι απαραίτητο να επιφέρει απαράλλακτες συνέπειες με το γάμο, π.χ. να επιτρέπει την υιοθεσία. Κάτι τέτοιο υπάρχει στη χώρα μας και είναι το σύμφωνο συμβίωσης που επιτρέπεται ανεξαρτήτως διαφοράς φύλου. Το σύμφωνο έχει αποτελέσματα περίπου όμοια με το γάμο και κατοχυρώνει τα δικαιώματα των παιδιών. Ένα παιδί που γεννιέται σε σύμφωνο (προσώπων διαφορετικού φύλου) είναι όπως ένα παιδί που γεννιέται σε γάμο. Δεν επιτρέπει την κοινή υιοθεσία για να προστατεύσει τα παιδιά, διότι το σύμφωνο λύεται και μονομερώς και αυτό είναι σύμφωνο με το ΕΔΔΑ. Η θέσπιση του συμφώνου συμβίωσης μεταξύ προσώπων ιδίου φύλου καθιστά περιττή τη θέσπιση γάμου. Ασχέτως των αντιρρήσεων για τη θέσπιση του συμφώνου, επιλύονται τα προβλήματα καταγωγής των παιδιών, διατροφής, κληρονομικού δικαίου, ασφαλιστικά και συνταξιοδοτικά.
2.Δεν είναι θέμα ισότητας στο γάμο. Για παράδειγμα, προβλέπονται διαφορετικοί τρόποι δημιουργίας της συγγένειας ανάλογα με το φύλο. Μήπως είναι και αυτό αντίθετο στην ισότητα; Ισότητα θα πει να προηγείται το συμφέρον του παιδιού, να συμμετέχουν οι γονείς αναλογικά στις ανάγκες της οικογένειας και να ασκούν την επιμέλεια μαζί. Βεβαίως προβλήματα μεταξύ των συζύγων και γονέων υπάρχουν πολλά, δεν λύνονται όμως με τη θέσπιση γάμου μεταξύ προσώπων του ιδίου φύλου, ούτε τεκμαίρεται ότι αυτοί θα είναι κατάλληλοι γονείς.
3.Το παιδί χρειάζεται δύο πρότυπα, του πατέρα και της μητέρας. Το παιδί σε ένα γάμο προσώπων του ιδίου φύλου με τον πατέρα 1 και τον πατέρα 2, δεν θα αποκαλέσει ποτέ κάποια γυναίκα «μητέρα» ή, αντιστρόφως, κάποιον άνδρα «πατέρα».
4.Ερωτάται πώς θα προστατευθεί το παιδί, αν δύο άνθρωποι του ιδίου φύλου το μεγαλώνουν και πάθει κάτι ο ένας. Το δίκαιό μας έχει μηχανισμούς προστασίας του παιδιού, όπως η επιτροπεία και η αναδοχή ανηλίκων. Δεν καταλήγει το παιδί στο ίδρυμα τόσο εύκολα.
5.Η τεχνητή συγγένεια της υιοθεσίας έχει ως σκοπό να εξασφαλίσει μια οικογένεια στο παιδί και όχι να επιλύσει με κάθε τρόπο την ατεκνία. Επιτρέπεται στο δίκαιό μας και σε εγγάμους, αλλά και σε αγάμους. Οι έγγαμοι όμως συνήθως πλεονεκτούν ως υποψήφιοι θετοί γονείς, διότι το συμφέρον του παιδιού εξυπηρετείται καλύτερα, όταν αυτό μεγαλώνει σε οικογένεια με το πρότυπο του πατέρα και της μητέρας. Επιπλέον μόνον στους εγγάμους επιτρέπεται η λεγόμενη κοινή υιοθεσία, δηλαδή να υιοθετήσουν και οι δύο σύζυγοι το ίδιο παιδί. Εάν θεσπισθεί ο «γάμος» μεταξύ προσώπων του ιδίου φύλου, είναι αναπόφευκτο ότι θα επιτραπεί και η υιοθεσία, αλλιώς θα θεωρηθεί αυτό διάκριση. Είναι όμως αυτό ό,τι πραγματικά συμφέρει το παιδί, που όπως τονίσαμε, στερείται της ευκαιρίας να έχει πατρικό και μητρικό πρότυπο; Εξάλλου και οι κοινωνικές υπηρεσίες θα αντιμετωπίσουν ανυπέρβλητες δυσκολίες με το μητρώο υποψηφίων θετών γονέων. Εάν προτείνουν να μην εγγραφεί ένα ζεύγος προσώπων ιδίου φύλου ή, αντιστρόφως, να εγγραφεί ένα ζεύγος συζύγων διαφορετικού φύλου, διότι αυτό συμφέρει τον ανήλικο, θα κατηγορηθούν για διάκριση από ένα ζεύγος «εγγάμων» προσώπων του ιδίου φύλου. Και πάλι το θύμα θα είναι το ανήλικο παιδί.
Συμπέρασμα: Το νομικό πλαίσιο στη χώρα μας αναγνωρίζει μόνον το γάμο μεταξύ προσώπων διαφορετικού φύλου, ο οποίος προστατεύεται από το Σύνταγμα. Η διαφορά φύλου είναι αυτονόητη και θεμελιώδης προϋπόθεση και προστατεύει το συμφέρον των παιδιών με το πρότυπο πατέρα και μητέρας. Θέσπιση γάμου και από πρόσωπα ιδίου φύλου δεν επιβάλλεται από το ευρωπαϊκό δίκαιο, είναι αντισυνταγματική και υποβιβάζει την έννοια του γάμου αντί να την ενισχύει. Με τους θεσμούς ας μην παίζουμε.
